Custom and practice

Definition: 

Something which has been done in a certain way and come to be the expected norm. In employment law, your contract of employment can change by custom and practice. For example, staff may have been allowed to go home early on Christmas Eve for several years. A court might decide against an employer who tries to change this practice, and rule that it has come to be included in your contract of employment by custom and practice, even though it may not be formally written down.
