Statutory fair reason

Definition: 

A fair dismissal is one that takes place because of:

  • your conduct;
  • your capability or qualifications for the job;
  • retirement at age 65 or the organisation's normal retirement age;
  • redundancy; or
  • a legal requirement that prevents the employment being continued (e.g. you are employed as a driver but no longer hold a driving licence).

If the reason is not one of these five, but there was some other substantial reason that justified your dismissal, then it can still be a fair dismissal.
