In the event of my employer's business being transferred to new ownership, does my new employer have to recognise my trade union?

Trade union recognition transfers under TUPE, but only if the group of transferring employees retains a separate identity within their new employer’s business.

If not, then the recognition agreement will lapse and must be renegotiated. It is important to use the consultation period to secure agreement on recognition following the transfer.
