Does the National Minimum Wage apply to staff on an annual salary?

Yes. The National Minimum Wage (NMW) applies to nearly all workers over 16 (who are above school-leaving age), regardless of how often they are paid.

If you would like to get an estimate of what your annual or monthly pay works out as an hourly rate, you can use our online Pay Reckoner.

Unions are expert at negotiating pay and ensuring that workers are paid at least the NMW for all the hours spent working. If you are concerned that you are not being paid at least the NMW for working time – which might include, for example, time spent travelling between shifts, undergoing security checks and searches or attending on-site training – you should contact your union rep. If you are not a union member, browse our Union Finder tool to find out which union best suits your needs, and to discover more about organising to secure union recognition at your workplace.

If you are concerned that your salary may work out less than the NMW for the hours you are contracted to work, you can check by calling the Acas Helpline on 0300 123 1100. NMW enforcement is carried out by a team of enforcement officers based at HM Revenue & Customs who can contact your employer to investigate allegations of non-compliance and collect any arrears on your behalf. With your consent, the Acas Helpline officer can pass the details of your complaint onto the NMW enforcement team at HMRC.
