I’m in a same-sex marriage. Do I have the same right to my partner’s benefits package as a heterosexual married partner would have?

Yes you do. In a landmark ruling in the case of Walker v Innospec Limited [2017], the Supreme Court has confirmed that same-sex couples in a civil partnership or marriage have all the same legal rights as married heterosexual couples, including as to pensions.

This ruling abolished an exemption in the Equality Act 2010 concerning occupational pension benefits which has been declared to be incompatible with EU law.
