I work part-time. Are my maternity rights different from those of full-time workers?

No, your maternity rights are the same as those of a full-timer. You are protected from unfavourable treatment by the sex discrimination and pregnancy and maternity discrimination provisions of the Equality Act 2010. In addition to this, under the terms of the Part-time Workers (Prevention of Less Favourable Treatment) Regulations 2000, you are entitled to insist on being treated at least as well as full-timers, with benefits pro rata to your hours.

However, there is an earnings test for SMP. You must have had average earnings of at least £113 a week in the eight weeks (or two months if monthly paid) before the 15th week before your due date. If you earn less than this, you may qualify instead for Maternity Allowance.
